The next Status Conference with the Court is scheduled for Feb. 9, 2021 at 1:30 p.m. We will post another News update within a day or two after sharing the results of the Status Conference. If you would like to file a response to the City’s cross-complaint, the City’s legal counsel is available to answer questions regarding how to make the filing. The City’s counsel cannot provide you with legal advice, however, they can assist in answering questions regarding the filing website and provide you with the correct forms. Please contract Patrick Skahan at [email protected] if you need assistance, or contact your own attorney. Filing information is available on:

The City is attempting to complete the Notice and Service process in the next few weeks. Completion of this process may involve personal service or posting on properties. If you wish to file a response to the City’s cross-complaint, you have 60 days to do so from the date when you receive the Notice or are Served, even if that date falls after the Jan. 29, 2021 deadline for responses. For those parties who are not successfully served through this final attempt, the City will ask the Court to serve them by publication in the local newspaper.

Background: On Sept. 15, 2020, the proposing parties (the coalition of large water users) released the proposed Physical Solution. Thereafter, the proposing parties held many meet and confer sessions with interested parties who wanted to better understand the components of the proposed solution. The proposing parties plan to release a revised version of the Physical Solution in late February. The proposing parties remain available to meet individually with interested persons who wish to learn more about the Physical Solution and its components. If you wish to schedule a meet and confer session, please contact Elizabeth Balloue at [email protected]; please note you will need to sign a confidentiality agreement.
